Justice For All (JFA) Statement on the Killing of Mohammad Jarghoun

Justice For All is deeply saddened and outraged by the killing of Mohammad Jarghoun, a journalist for Smart Media, who was fatally shot by Israeli soldiers while reporting in southern Gaza in October. This tragic event underscores the perilous conditions journalists face while covering conflicts and the grave consequences of failing to protect media workers in these volatile environments.

Mohammad Jarghoun’s death is a stark reminder of the risks journalists undertake to bring critical news to the global audience. His killing not only represents a profound loss for his family and colleagues but also signifies a blatant attack on press freedom and the public’s right to information.

In light of this tragedy, JFA has called upon the International Criminal Court (ICC) to recognize the targeted killing of journalists as a war crime under the Rome Statute. The legal framework provided by the Rome Statute, including Articles 8(2)(b)(ii) and 8(2)(c)(ii), explicitly prohibits violence against civilians, including journalists, underscoring the need for accountability in such cases.

The international community must not stand by as journalists are targeted with impunity. The response from UNESCO Director-General Audrey Azoulay, condemning the killing and calling for a full investigation, echoes our call for justice and the need to uphold international laws designed to protect journalists.

JFA urges the ICC to take swift and decisive action in response to our submission, to ensure that those responsible for the killing of Mohammad Jarghoun are held accountable. It is imperative that we see justice served, not only as a matter of principle but as a deterrent against future attacks on the press.

The safety of journalists is fundamental to the functioning of a free and informed society. Attacks on journalists are attacks on the very foundation of democracy and human rights.
